Refund policy

RIGHT OF WITHDRAWAL

Purchases made on www.vinaidelborgo.com are subject to the provisions of Legislative Decree 206/05, which guarantees the right to withdraw from the purchase contract.

Conditions for exercising the right of withdrawal

  • The right of withdrawal is reserved exclusively for consumers, as defined by Legislative Decree 206/05, and therefore excludes purchases made by resellers or entities purchasing for resale purposes.
  • Return shipping costs shall be borne exclusively by the Customer.

Order cancellation by the Customer

If the Customer decides to cancel an order for any reason not attributable to the Seller, any refund due will be processed net of all expenses incurred by the Seller, including but not limited to:

  • Payment processing fees (e.g., credit card, PayPal, Stripe, etc.)
  • Currency exchange fees
  • Shipping costs incurred for order dispatch (even if shipping was free for the Customer)

These amounts will be automatically deducted from the refunded amount.

Procedure to follow

The withdrawal request must be sent to T.C.S. Borgogno S.R.L. within 31 days from the date the ordered goods were received. The communication may be anticipated via fax or email, but must be confirmed via registered mail with acknowledgment of receipt within 48 hours, including:

  • Order number and order date
  • Invoice number
  • List of products subject to withdrawal (identified by item code)

Return conditions and timeframes

Products must be returned in excellent condition, in their original packaging, and with adequate protection to prevent damage, markings, and/or alterations.

Returns will not be accepted if:

  • Products have been used or damaged, even due to inadequate packaging or carrier mishandling
  • Products have damaged labels or packaging

The Customer must arrange and pay for the return shipment within 31 days from the withdrawal notification, to the following address:

  • Tuesday to Saturday:
    • 10:00 AM - 12:30 PM
    • 3:30 PM - 7:30 PM

⚠️ Returns sent with freight collect or using unauthorized return methods will not be accepted.

Refund procedure and timeframes

T.C.S. Borgogno S.R.L. commits to refunding the Customer within 10 days from the return of the goods.

  • The refund will be issued via bank transfer to the IBAN provided by the Customer in the withdrawal request.
  • The refund will be net of shipping costs incurred by the Seller.

If an order is canceled by the Customer for reasons not attributable to the Seller, the refund will be deducted by all expenses incurred by the Seller, as outlined in the previous section.

Warranty and liability

The Company guarantees that its products are free from defects. If a Customer discovers a defect, they must report it within two months from the date of discovery (Art. 132 Legislative Decree 206/2005 – Consumer Code).

Limitation of liability

The Company shall not be liable for:

  • Service disruptions due to force majeure (e.g., accidents, strikes, natural disasters, etc.)
  • Losses, damages, or costs incurred due to failure to fulfill the contract for reasons beyond the Company’s control
  • Fraudulent use of credit cards or other payment methods by third parties, provided the Company has taken all possible precautions according to the best available knowledge and experience

Applicable law - Jurisdiction

Contracts concluded with the Company are governed by Italian law.

  • For disputes with Italian consumers, jurisdiction lies with the court of the consumer’s place of residence.
  • For all other cases, exclusive jurisdiction is assigned to the Court of Cuneo, with no competing jurisdictions allowed.
